1. Agreement to Terms

By accessing or using Nativ (“the Service”), you confirm that you have read, understood, and agreed to be bound by these Terms of Service. If you do not agree, you must stop using the Service immediately. We may update these terms at any time by posting a revised version; your continued use after the update date constitutes acceptance.

2. Eligibility

You must be at least 13 years old to use Nativ. If you are under 18, you confirm that you have parental or guardian consent and that they have read and agreed to these terms on your behalf. By using the Service, you represent and warrant that all information you provide is accurate, current, and complete.

3. Our Intellectual Property

Nativ and its underlying technology, source code, design, and trademarks are owned by or licensed to us and are protected by applicable intellectual property laws. Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

You may not copy, reproduce, distribute, modify, reverse-engineer, or create derivative works of any part of the Service without our express prior written consent.

4. Your Content

• You retain full ownership of any PDF files and content you upload.
• By uploading content, you grant Nativ a limited, non-exclusive license to process it solely to provide the Service (storage, indexing, AI responses). This license ends when you delete the content or your account.
• You represent and warrant that you have the legal right to upload any file — do not upload content you do not own or are not licensed to use.
• You are solely responsible for the accuracy and legality of your uploaded content. We may remove content that we determine, in our sole discretion, violates these terms.
• We do not claim ownership of your content and will not share it beyond what is described in our Privacy Policy.

5. Prohibited Activities

You agree not to:

• Upload content that is illegal, infringing, defamatory, obscene, harmful, or violates any third party's rights.
• Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the Service.
• Use bots, scrapers, or automated tools to access the Service without our written permission.
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
• Use the Service to generate or distribute harmful, misleading, or illegal content.
• Share, sell, or transfer your account credentials to any third party.
• Circumvent subscription tiers, rate limits, or any technical restrictions of the Service.
• Use the Service in any way that violates applicable laws or regulations in your jurisdiction.

6. Free & Paid Plans

• The Free plan is provided at no charge and is subject to usage limits that may change over time.
• Plus plan subscriptions are billed monthly or annually. All payments are processed by LemonSqueezy, our merchant of record.
• Subscriptions auto-renew unless cancelled before the next billing date. You may manage or cancel at any time from the billing settings page.
• All purchases are non-refundable. See our Refund Policy for details on exceptional circumstances.
• We reserve the right to modify pricing or plan features with reasonable advance notice.

7. AI-Generated Content

Nativ uses third-party AI models (including OpenAI) to generate responses based on your uploaded documents. AI outputs may contain errors, inaccuracies, or omissions. You should not rely solely on AI-generated content for any critical, legal, medical, financial, or other important decisions. We are not responsible for the accuracy or completeness of AI-generated outputs.

8. Copyright Infringement

We respect intellectual property rights. If you believe that content on the Service infringes your copyright, please contact us at support@nativ.to with a description of the work, the location of the allegedly infringing material, and your contact information. We will investigate and remove infringing material where appropriate.

9. Service Availability & Modifications

We aim for high availability but do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue any feature or the Service itself at any time. We will provide reasonable notice of significant changes where possible.

10. Account Termination

You may request deletion of your account by contacting us at support@nativ.to. We may suspend or terminate your account if you violate these terms, with or without notice depending on the severity of the violation. Upon account deletion, your data is permanently removed from our systems within 30 days.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NATIV AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $10 USD IF YOU HAVE NOT MADE ANY PAYMENTS.

13. Governing Law & Disputes

These terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the appropriate courts in the jurisdiction where the Service operator is located.
